Industry Welding Patents Spark Dispute with Judge Geraghty

SILICON Holding B.V. v. Brand Industrial Services, Inc., Civil Action No. 1:23-cv-03323-SEG (N.D. Ga. July 27, 2023)

Plaintiff SILICON Holding B.V. brought suit for patent infringement in the Northern District of Georgia relating to four patents directed to certain refractory anchor assemblies and related components used in industrial welding operations. SILICON is a metal fabrication company that specializes in heat-resistant products used in the petrochemical, cement, incineration, steel and power industries. The Patents-in-Suit are U.S. Patent Nos. 10,190,314, 10,961,712, and 11,428,007, and U.S. Design Patent No. D947,009.

According to the complaint, Defendants Brand Industrial Services, Inc., BrandSafway, LLC, and Industrial Specialists, LLC (“Defendants”) are direct competitors in the field of refractory anchors and related welding services. Dkt. 1 at 19. The complaint alleges that Defendants infringe Plaintiff’s patents when they offer certain refractory services and welding solutions, and when they use certain refractory anchors, which they separately offer for sale.

Plaintiff brings counts for willful direct and indirect patent infringement against all Defendants for all four patents.

The case has been assigned to Judge Sarah Geraghty.
