The $uicideboy$ Sue Counterfeiters, Bootleggers Over Merchandise Sales

“The $uicideboy$” have brought suit in the Northern District of Georgia for trademark infringement. Plaintiffs Scott Arcenaux, Jr., known professionally as “Scrim,” and Aristos Petros, known professionally as “Ruby Da Cherry,” are members of the musical recording and live concert touring duo “The $uicideboy$” (“SSB”). Together, they own G59 Merchandising, LLC, the entity through which the duo market and sell merchandise bearing their names and likenesses.

According to the Complaint, Defendants are various John and Jane Does who sell counterfeit and bootleg merchandise that infringes the SSB’s intellectual property rights. SSB alleges to own the registered marks $UICIDEBOY$ and logo design (U.S. Trademark Reg. No., 5,967,818); G59 and logo design (U.S. Trademark Reg. No. 5,938,446); and G59 RECORDS (U.S. Trademark Reg. No. 5,938,445); as well as common law rights for GREYFIVENINE, GREY59, G59 GREYDAY and related marks. Dkt. 1 at 4-5.

The Complaint brings various counts under the Lanham Act, including infringement, dilution, and false designation of origin.   

The case has been assigned to Judge Steven Grimberg.
