Brown v. South Florida Assets & Operations LLC, Civil Action No. 1:23-cv-03106-MHC (N.D. Ga., July 13, 2023)

A photographer has filed suit in the Northern District of Georgia for copyright infringement.

Defendant, South Florida Assets & Operations LLC, operates a website selling new and used boats on the east coast of South Florida (the “Website”). Dkt. 1 at ¶ 22. According to the Complaint, “Defendant volitionally copied and/or displayed Plaintiff’s copyright protected Photograph on the Website.” Id. at ¶ 24. The Photograph in dispute portrays a man and woman sitting inside a boat. Id. at ¶ 2. After observing the Infringement, Plaintiff allegedly attempted to contact Defendant through electronic and physical mail with no success. Id. at ¶ 27. Plaintiff brings one count of direct copyright infringement.

The case has been assigned to Judge Mark Howard Cohen.
