Pure Earth Botanics, LLC v. Google LLC et al, Civil Action No. 1:23-cv-00787-VMC (N.D. Ga., Feb. 21, 2023)

A business selling dietary and nutritional products intended for weight loss has brought suit in the Northern District.

The Plaintiff, Pure Earth Botanics, sells weight loss pills under the registered trademark “KETOMELT,” used continuously since at least 2019. The Complaint alleges the Defendants, including a long list of vitamin manufacturers and online retailers, of unauthorized use of the Mark in connection with sales and domain names.

The Complaint brings counts for Federal Trademark Infringement, Unfair Competition, and Dilution, as well as tortious business interference.

The case has been assigned to Judge Victoria Calvert.
