Osseo Imaging, LLC v. Carestream Dental LLC, Civil Action No. 1:23-cv-03116-LMM (N.D. Ga., July 14, 2023)
Osseo Imaging, LLC (“Osseo”) has filed suit in the Northern District of Georgia for patent infringement.
Osseo describes itself as “the owner of a family of patents relating to dental imaging systems.” Dkt. 1 at ¶ 1. According to the Complaint, “Osseo Patents teach improved dental X-ray imaging systems for generating tomographic models of dental structures.” Id. at ¶ 12. These patents claim multiple aspects of the dental imaging system such as controllers, sensing equipment, and input/output devices. Id. at ¶ 13. Osseo alleges Carestream Dental LLC (“Carestream”) has infringed on their patents by selling and offering for sale a family of 3D dental imaging systems that used the CS Imaging and CS 3D Software on computerized devices (the “Accused Systems”). Id. at ¶ 17. The Complaint alleges Carestream violated the tolling agreement, which established the damages period, by selling the Accused Systems, therefore infringing on Osseo’s ‘301 and ‘374 Patent. Id. at ¶ 23.
This is not the first time Osseo has asserted these patents. According to the Complaint, Osseo previously filed suit against Planmeca USA for infringing on their patents through the creation of Planmeca’s ProMax systems with Romexis software (“Planmeca 3D Systems”). Id. at ¶ 14. A jury found in that the Planmeca 3D systems infringed on multiple Osseo patents, resulting in Osseo being awarded damages of $2,300,000. Id. at ¶ 16. Osseo brings two counts of patent infringement against Carestream.
