Here’s Hoping Karmagreen Has Good Karma: Dietary Product Company, Karmagreen LLC, Alleges Over 15 Counts of Patent Infringement

Karmagreen, LLC v. Elnaham, Civil Action No. 1:22-cv-02581-WMR (N.D. Ga. June 28, 2022):

Plaintiff Karmagreen, LLC, filed suit against Defendants Mahmood Elnaham and Ismail Elnaham in the Northern District of Georgia (Atlanta Division) on June 28, 2022 asserting claims of willful and indirect (contributory and induced) patent infringement totaling 16 counts of patent infringement. Specifically, Karmagreen alleges that Defendants infringe upon U.S. Patent Nos. 10,624,902 (the “’902 patent”), 11,324,754 (the “’754 Patent”), 11,324,755 (“the ’755 Patent), 11,337,986 (the “’986 Patent”), 11,344,560 (the “’560 Patent”), 11,318,146 (the “’146 Patent”), 11,324,756 (the “’756 Patent”), and 11,318,147 (the “’147 Patent”) (collectively, the “Patents-in-Suit”). The Patents-in-Suit are entitled “Dietary Supplement” and generally directed towards supplements that include ingredients varying from tianeptine-based combinations, Kava, CDP choline, Alpha GPC, and Sakae Naa.

According to the Complaint, Karmagreen – a dietary product company that has a product line called Tianaa – solely owns the Patents-in-Suit. Further, the Complaint alleges that Defendants have infringed the Patents-in-Suit by instructing/contributing to the directly infringing conduct of MRSS, an entity owned and operated by Defendants. MRSS, Defendants allege, develop, sell, distribute and/or manufacture ZaZa Products (i.e., ZaZa Red, ZaZa White, and Noga 530), which are remodeled after Plaintiffs’ Tianaa products per Defendants’ request.

This case has been assigned to Judge William Ray II.
