Sadowski v. New Beginning Kidney Foundation, Civil Action No. 1:22-cv-02422-LMM (N.D. Ga. June 16, 2022):

On the heels of Plaintiff Christopher Sadowski’s copyright infringement suit against Defendant Bre Law, LLC settling in May 2022 (discussed here), Sadowski has now filed suit against New Beginning Kidney Foundation based on the same copyrighted photo of a crime scene. Sadowski asserts claims against Defendant New Beginning Kidney Foundation for (1) copyright infringement under 17 U.S.C. § 101, et seq. and (2) removal of copyright management information under 17 U.S.C. § 1202.

According to the Complaint, Defendant is the owner and operator of the website https://www.newbeginningkidney.com/. Sadowski alleges that, in December 2019, Defendant posted Sadowski’s crime scene photograph on its website without Sadowski’s authorization or photo credit. Further, Sadowski alleges that Defendant created an unauthorized copy of the photograph, removing a photo credit that appeared in the bottom left corner of the photo before posting the image on its website. The Complaint states that Sadowski communicated with Defendant in hopes of resolving the underlying matter, but no resolution was reached. This case has been assigned to Judge Leigh Martin May.
