Ex-Consultant Allegedly Stole Over 30,000 Sensitive Documents From Young & Associates’ Google Drive

R.L. Young, LLC v. Undisputed Consulting, LLC et al., Civil Action No. 1:22-cv-02397-ELR (N.D. Ga. June 14, 2022):

Plaintiff R.L. Young LLC (doing business as Young & Associates) filed suit against Defendants Undisputed Consulting, LLC and Michael Walker on June 14, 2022 in the Northern District of Georgia (Atlanta Division). In the Complaint, Plaintiff asserts claims of (1) trade secret theft under the Defend Trade Secrets Act, 18 U.S.C. § 1125 et seq., (2) trade secret theft under Georgia’s Trade Secrets Act, (3) violation of Georgia’s Computer Systems Protection Act, (4) breach of contract, (5) tortious interference with contractual relations, and (6) civil conspiracy.

According to the Complaint, Plaintiff is a company that provides property damage assessment and cost estimating, and Defendant Walker previously worked as a consultant for Plaintiff where he had access to Plaintiff’s password-protected, cloud-based platforms. The linchpin of the Complaint is Plaintiff’s allegation that Defendant Walker—while working as a consultant for Plaintiff—used an external hard drive to transfer over 30,000 files containing highly sensitive and confidential business and customer information from Plaintiff’s Google Drive workspace to Defendant Undisputed Consulting’s computing network. The Complaint further alleges that Defendant Walker and others at Undisputed Consulting have since used this information to compete unfairly against Plaintiff and have otherwise unfairly benefitted from such.

Along with the Complaint, Plaintiff simultaneously moved for a temporary restraining order. The Court is currently set to hear Plaintiff’s motion for temporary restraining order on July 12, 2022. This case has been assigned to Judge Eleanor L. Ross.
