Mark Seliger v. CSP Music Group, Inc. & Christopher Starr, Civil Action No. 1:22-cv-02435-SDG (N.D. Ga. June 17, 2022)

Plaintiff Mark Seliger filed suit against Defendants CSP Music Group, Inc. and Christopher Starr for copyright infringement in violation of the Copyright Act, 17 U.S.C. 106 in the Northern District of Georgia (Atlanta Division). Plaintiff is the owner and creator of a photograph of Chance the Rapper entitled “23_2016_101_C_1085_RT” in 2016 which was registered with the United States Copyright Office on April 21, 2017:

Defendants–a full service entertainment logistics company and its CEO–operate a website to promote and advertise their recording and marketing services for independent and professional recording artists. The Complaint alleges that Defendants copied Plaintiff’s Copyrighted Work on its website “in order to advertise, market and promote their business activities.” Plaintiff alleges that it never licensed the Copyrighted Work to Defendants or authorized Defendants to recreate and distribute the Copyrighted Work on their website. Plaintiff notified Defendants of its allegations of copyright infringement on December 2, 2020, December 18, 2020, and January 26, 2021 but never received any response. The Complaint asserts a single claim for copyright infringement and seeks an injunction pursuant to 17 U.S.C. 501, actual damages and Defendants’ profits or statutory damages provided in 17 U.S.C. 504. The case has been assigned to Judge Steven Daniel Grimberg.
