Sama Camp, LLC v. Sama Tea, LLC et al., Civil Action No. 1:22-cv-01722-TCB (N.D. Ga. May 1, 2022)

Plaintiff Sama Camp, LLC filed suit against Defendants Sama Tea, LLC, Sama Worldwide Inc., Sama Beverages, LLC and 100.co on May 1, 2022 in the Northern District of Georgia (Atlanta Division). The Complaint alleges that Plaintiff has marketed and sold its proprietary blend of teas and health cleansing products under the federally-registered mark “SAMA” since as early as 2017.

See Ex. A. The Complaint further alleges that Defendants market and sell a competing line of tea products and blends under the name “Sama Tea” notwithstanding their knowledge and awareness of Plaintiff’s federally-registered mark.

The Complaint asserts claims for (1) federal trademark infringement under 15 U.S.C. § 1114(1), (2) false designation of origin under 15 U.S.C. § 1125(a), (3) common law trademark infringement under Georgia common law, (4) attorneys’ fees under O.C.G.A. § 13-6-11. The case has been assigned to Judge Batten in the Northern District.
