Hitachi on the Receiving End of Patent Infringement Suit over its "Compute Systems"

Hitachi, Ltd., which recently filed a patent infringement lawsuit over power tools (see our August 7, 2012 post here), has found its subsidiary, Hitachi Data Systems Corporation (“Hitachi”), on the receiving end of a new patent infringement suit over its “Hitachi Compute Systems.”

On August 28, 2012, Acceleron, LLC (“Acceleron”), a Delaware company based in Atlanta, Georgia, filed a complaint in the Northern District of Georgia against Hitachi, a Delaware corporation based in Santa Clara, California, alleging infringement of U.S Patent No. 6,948,021 (the “‘021 Patent”).

According to the specification, the ‘021 Patent, entitled “Cluster Component Network Alliance System and Method for Enhancing Fault Tolerance and Hot-Swapping,” issued on September 20, 2005 and generally relates to fault tolerant computer systems used for hot-swapping components with reduced downtime and without the need for trained technicians.  Acceleron claims that Hitachi infringes one or more claims of the ‘021 Patent by manufacturing, using, selling, importing, or offering to sell Hitachi’s Compute Systems, including the Hitachi Compute Blade 2000, the Hitachi Compute Blade 500, and the Hitachi Compute Blade 320.  Acceleron asks the Court to award it damages, attorneys’ fees, costs, and to permanently enjoin Hitachi from further alleged infringement.

The case is Acceleron, LLC v. Hitachi Data Systems Corp., No. 1:12-cv-2996, U.S. District Court for the Northern District of Georgia, Atlanta, Division, and is assigned to U.S. District Judge Timothy C. Batten.
