Imposter Syndrome – ATL Beltline and Beltline Conduit Involved in Trademark Dispute

Atlanta Beltline, Inc. v. Beltline Conduit LLC et al , Civil Action No. 1:23-cv-03128-MLB (N.D. Ga., July 14, 2023)

Atlanta Beltline, Inc (“ABI”) has filed suit in the Northern District of Georgia for trademark infringement under federal and state causes of action.

According to the Complaint filed on July 14, ABI is the “most comprehensive revitalization effort ever undertaken in the City of Atlanta and among the largest, most wide-ranging redevelopment and mobility projects currently under way in the United States.” Dkt. 1 at ¶ 10. ABI has operated under the trademark ATLANTA BELTLINE along with the website www.beltline.org since 2004. Id. at ¶ 14. According to the Complaint, Defendants Beltline Conduit LLC (“Conduit”) and Quinn registered the Internet domain name www.beltlineconduit.net on August 25, 2022, fully incorporating the BELTLINE name. Id. at ¶ 28. ABI alleges, “Defendants’ registration and use of the Infringing Names in connection with their businesses dilutes the distinctiveness of the ABI Marks and reduces the ability of the ABI Marks to distinguish any goods and services offered by ABI from the goods and services offered by others, including the Defendants.” Id. at ¶ 31. In response to the infringing activities, ABI sent Defendants multiple cease-and-desist letters but received no response from Defendants. Id. at ¶¶ 33-34.

Plaintiff brings various trademark infringement allegations against Conduit.

The case has been assigned to Judge Michael Lawrence Brown.
