Strike 3 Holdings, LLC (“Strike 3” or “Plaintiff”) has filed twelve lawsuits in the Northern District of Georgia for copyright infringement.
Strike 3 has brought suit against twelve individuals only identifiable by their IP addresses. According to the Complaint, the numerous individuals downloaded the motion pictures onto a distribution file network using the BitTorrent protocol. Dkt.1 at ¶ 4. Each defendant has allegedly infringed over hundreds of adult movies over an extended period. Id. The Complaint alleges “Plaintiff has developed, owns, and operates an infringement detection system, named ‘VXN Scan.’” Id. at ¶ 27. Using VXN Scan, Plaintiff, the owner of Strike 3, allegedly discovered Defendants used the BitTorrent network. Id.at ¶ 28. According to the Complaint, VXN Scan is “incapable” of uploading content to any BitTorrent user. Id. at ¶ 36.
Plaintiff brings one count of direct copyright infringement against the numerous, unnamed individuals. The cases have been assigned to Judge Steven Grimberg.
