Fortune v. Scenes Media, LLC, Civil Action No. 1:23-cv-03059-AT (N.D. Ga., July 11, 2023)

A photographer has filed suit in the Northern District of Georgia for copyright infringement.

The Defendant, Scenes Media, LLC, is a media company that owns a website at scenesmedia.com (“the Website”). Dkt.1 at ¶ 2. Plaintiff alleges Defendant “actively copied and/or displayed the Photograph on the Website and engaged in this misconduct knowingly and in violation of the United States copyright laws.” Id. at ¶ 4. The photograph at issue depicts James Patrick Page, a guitarist for the English rock band Led Zeppelin. According to the Complaint, Scenes Media “was aware of facts or circumstances from which the determination regarding the Infringement was apparent.” Id. at ¶ 40. Plaintiff alleges they contacted Defendant on three separate occasions, all which “received no response from Defendant.” Id. at ¶ 38.

Plaintiff brings one count of copyright infringement. The case has been assigned to Judge Amy Totenberg.
