Like a Rose that Grew from Concrete – Infringement of 2Pac Photograph Leads to Copyright Suit with Media Company

A photographer has filed suit in the Northern District of Georgia for copyright infringement.

Plaintiff registered a photograph in February 2004 under U.S. Registration No. VA 1-233-155 (“the Photograph”). The Photograph at issue depicts deceased rapper Tupac Shakur being transported into an ambulance after he was assaulted at the Quad Studio in Manhattan, New York. Plaintiff alleges According 2 Hip-Hop LLC, a media company, operates a Facebook account (“the Account”), in which they “actively copied and/or displayed the Photograph on the Account and engaged in this misconduct knowingly and in violation of the United States copyright laws.” Dkt.1 at ¶ 4. According to the Complaint, after observing the Infringement, Plaintiff emailed and/or sent physical mail to Defendant through counsel three times, and to each attempt, “Defendant never responded.” Id. at ¶ 29.

Plaintiff brings one count of copyright infringement. The case has been assigned to Judge Sarah Geraghty.
