EFA, Inc. v. The Marena Group, LLC, Civil Action No. 1:23-cv-02629-MLB (N.D. Ga., Jun. 13, 2023)
Plaintiff, doing business as “Elastic Fabrics of America,” files suit in the Northern District of Georgia for patent infringement. Plaintiff is a medical textiles producer that creates compression fabrics. Complaint, ¶ 7. U.S. Patent No. 7,555,922 is directed toward “an improved elastomeric fabric . . . [that] provides improved durability and power characteristics”. Id. at ¶ 11; U.S. Patent No. 7,555,922 (issued Jul. 7, 2009). EFA and Marena entered into an Exclusive Supplier Agreement where EFA agreed to sell its patented fabric to only Marena for 10 years. Complaint, ¶ 17. Plaintiff alleges that Marena abruptly stopped sourcing the fabric from EFA and began producing or importing an infringing fabric with similar specifications. Id. at ¶ 23. EFA asserts that the minor differences in the fabric specifications do not avoid infringement. Id. at ¶ 28.
The complaint brings one count of patent infringement under 35 U.S.C. § 271.
