Live Performances of Copyrighted Music Lead to Infringement Action

Plaintiffs filed suit in the Northern District of Georgia for copyright infringement. Plaintiffs are members of the American Society of Composers, Authors, and Publishers, which represents, licenses, and protects the public performance rights of over 875,000 songwriters, composers, and music publishers. Complaint, ¶ 13. In the Complaint, Plaintiff asserts that Defendants were responsible for public performances of Plaintiffs’ copyrighted musical compositions. Id. at ¶ 3. Defendant allegedly operates a Music Hall that hosts live performances. According to the Complaint, since the alleged infringement in April 2023, Plaintiffs attempted to contact Defendants approximately 80 times to offer a license for the performances, which the Defendants refused. Id. at ¶ 15-16. Plaintiffs seek between $750 and $30,000 for each of three causes of action.
